John Przybyla, 76, from Friendship, Wisconsin, was pulled over by police in October 2014 after driving erratically.
When told that he had alcohol on his breath, he said it was because he had just eaten beer-battered fish at a roadside restaurant.
After his arrest, Przybyla refused to take a blood test, saying that it was against his religion. A preliminary breath test had earlier revealed a blood-alcohol level of 0.062, according to court documents.
For people who have been convicted of three or more drink-driving offences in Wisconsin, the legal limit is 0.02.
On Monday (8 February) Judge Alan White ordered further investigation into the case before sentencing. No definite date for sentencing has been placed.
